Terms of Service

These Terms of Service ("Terms") govern your use of the Mutter iOS application ("the App"), developed and operated by Gabriel Prince ("I," "me," or "my"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

Mutter is an iOS application that uses voice input and artificial intelligence to help you capture, organize, and manage thoughts, tasks, ideas, reminders, grocery lists, and notes. The App converts speech to text on your device, processes the text using AI to categorize and organize it, and stores the results locally (with optional iCloud sync).

2. Eligibility

You must be at least 13 years old to use Mutter. By using the App, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. Subscriptions & Payment

3.1 Subscription Plans

Mutter offers the following auto-renewable subscription plans:

• Monthly: $7.99 per month
• Yearly: $49.99 per year

Both plans include a 3-day free trial for new subscribers.

3.2 Free Trial

New subscribers are eligible for a 3-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin, and you will be charged the applicable subscription fee.

3.3 Billing & Renewal

All subscriptions are managed through the Apple App Store and processed using Apple's StoreKit 2. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

3.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period. You will retain access to subscription features until the end of your paid period. No refunds are provided for partial billing periods.

3.5 Price Changes

I reserve the right to change subscription pricing. Any price changes will be communicated in advance and will apply to the next billing cycle after the change, in accordance with Apple's policies. You will have the opportunity to accept or decline the new pricing.

4. Acceptable Use

You agree to use Mutter only for lawful purposes. You may not:

• Use the App to process, store, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to abuse, exploit, or manipulate the AI processing features of the App
• Use the App to generate spam, phishing content, malware, or any form of malicious content
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
• Use the App in any manner that could disable, overburden, or impair its functionality
• Access or attempt to access the App's backend systems, servers, or APIs without authorization
• Resell, sublicense, or redistribute the App or its features

5. Intellectual Property

The App, including its design, code, features, graphics, and branding, is owned by Gabriel Prince and is protected by intellectual property laws. These Terms do not grant you any rights to use the Mutter name, logo, or branding.

You retain ownership of all content you create using the App (your mutters, tasks, ideas, notes, etc.). By using the App, you grant me a limited, non-exclusive license to process your content solely for the purpose of providing the App's services (e.g., AI categorization and organization).

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

I do not warrant that:

• The App will be available at all times or operate without interruption
• AI categorization, sorting, or transcription will be accurate or error-free
• The App will meet your specific requirements
• Any errors or defects will be corrected

You acknowledge that AI-powered features may occasionally produce inaccurate or unexpected results, and you are responsible for reviewing and verifying all output.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Gabriel Prince shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the App.

In no event shall my total liability to you exceed the amount you have paid for the App in the twelve (12) months immediately preceding the event giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Gabriel Prince from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any applicable law or regulation.

9. Third-Party Services

The App integrates with third-party services, including but not limited to Apple's iCloud, EventKit, and Anthropic's Claude API. Your use of these services is subject to their respective terms and privacy policies. I am not responsible for the availability, accuracy, or practices of any third-party services.

10. Termination

I reserve the right to suspend or terminate your access to the App at any time, with or without cause and with or without notice, if I believe you have violated these Terms. Upon termination, your right to use the App ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination.

11. Modifications to the Terms

I may modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the App after any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you should stop using the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Gabriel Prince regarding your use of the App, superseding any prior agreements.
